CMA's Health Law Library updated with 2018 content

CMA On-Call—the California Medical Association (CMA) online health law library—has been updated with 2018 content. One of CMA's most valuable member benefits, the health law library contains nearly 5,000 pages of up-to-date legal information on a variety of subjects of everyday importance to practicing physicians. California regulations regarding retention of medical records in a physician’s office are a perennial hot topic in the California Medical Association (CMA) On-Call health law library. HHS modifies HIPAA Privacy Rule as part of executive actions to curb gun violence

Last week, the Obama Administration unveiled a number of executive actions to address gun violence in the United States, including an amendment to the Health Insurance Portability and Accountability Act (HIPAA) that would make it easier for mental health providers to disclose the identities of individuals who are disqualified from shipping, transporting, possessing or receiving a firearm. Physicians warned of identity theft tax scam

For a second year, the California Medical Association (CMA) has received reports from physicians that fraudulent federal income tax returns have been filed using physician names, addresses and social security numbers. In many cases the fraudulent tax return includes the name of an unknown person listed as the physician's spouse. Generally, this other name is a prior patient of the physician. Congress passes Medicare payment reform and eliminates SGR

Last week, the U.S. Senate overwhelmingly passed H.R. 2 with a 92-to-8 vote, which will completely overhaul the Medicare payment program. This move, which follows the U.S. House of Representatives’ near-unanimous vote two weeks ago, is a monumental, bipartisan action taken by Congress that negates the Medicare sustainable growth rate (SGR) formula and extends the Children’s Health Insurance Program (CHIP).
